1. Acceptance of Terms
By engaging Development Edge (operated by Dinero Services LLC) for services or using this website, you agree to be bound by these Terms of Service. If you do not agree, do not use our services.
2. Services Provided
Development Edge provides custom branded operational dashboard software for businesses, including initial configuration or development, hosting under a monthly subscription, and ongoing maintenance and support. The specific scope of services is agreed upon during the Discovery phase prior to any work beginning.
3. Payment Terms
- One-time setup fees are due upon project initiation and are non-refundable once work has begun.
- Monthly subscription fees are billed in advance on a monthly basis.
- Payment plans on setup fees are available upon request and subject to written agreement.
- Failure to pay monthly fees may result in suspension of dashboard access.
4. Cancellation
- Monthly subscriptions may be cancelled at any time with no cancellation fee.
- Upon cancellation, service continues through the end of the current billing period. No partial-month refunds are issued.
- Setup fees are non-refundable under any circumstances.
5. Data Ownership
You retain full ownership of your business data at all times. Development Edge will not sell, share, or use your data for any purpose other than providing and improving your dashboard service. Upon request following cancellation, we will provide a complete export of your data within 14 business days.
6. Intellectual Property
The underlying dashboard platform, codebase, templates, and components are the proprietary property of Dinero Services LLC dba Development Edge. You are granted a limited, non-exclusive, non-transferable license to use the dashboard during your active subscription.
Custom features developed specifically for your business and fully paid for become your property upon payment completion.
7. Acceptable Use
You agree not to use the service for any illegal, fraudulent, or unauthorized purpose. Clients on Starter or Growth plans may not resell, sublicense, or white-label our services to third parties. An active Agency/Enterprise plan is required for multi-client deployments.
8. Service Availability
We will make commercially reasonable efforts to maintain consistent uptime and service availability. We do not guarantee uninterrupted service and are not liable for downtime caused by third-party infrastructure, internet outages, or circumstances beyond our reasonable control.
9. Limitation of Liability
In no event shall Development Edge or Dinero Services LLC be liable for indirect, incidental, special, or consequential damages arising from your use of our services. Our total cumulative liability for any claim arising under these Terms shall not exceed three (3) months of subscription fees paid by you in the period preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless Development Edge and Dinero Services LLC from any claims, damages, or expenses arising from your use of the service, your violation of these Terms, or your violation of any rights of a third party.
11. Modifications to Terms or Services
We reserve the right to modify these Terms at any time. Active clients will be notified via email at least 30 days before material changes take effect. Continued use of the service after notice constitutes acceptance of the updated Terms.
12. Termination
We reserve the right to suspend or terminate service for any violation of these Terms, with or without prior notice depending on the severity of the violation.
13. Governing Law & Disputes
These Terms are governed by the laws of the State of New Jersey, United States. Any disputes arising under these Terms shall be resolved in the state or federal courts located in New Jersey. You consent to personal jurisdiction in those courts.
